These Terms of Use govern access to, browsing of, and use of the L’Artelier by Kate website. Every visitor or user of the website is required to read the content of these terms carefully before using it.

Accessing and remaining on the website, as well as using any part, service, form, or content of it, implies acceptance of these Terms of Use. If you do not agree with any part of them, please do not use the website.

These Terms primarily concern the general use of the website, its content, and the communication services provided through it. For more specific matters relating to the purchase of artworks, custom orders, payments, shipping, cancellations, or refunds, the separate Terms of Sale & Orders shall apply additionally and take precedence.

2. Website Ownership and Management

The L’Artelier by Kate website belongs to the artist and constitutes the official online space for presenting her work, artistic identity, and the available services or communication options related to her artistic activity.

The technical, operational, and administrative support of the website is provided by AimHigh Agency, which acts as the website administrator for matters relating to technical operation, structure, content management, and related processes.

For matters related to the operation of the website, communication through the forms, or the general management of the site, the contact details of the administrator may be used.

3. Purpose of the Website

The purpose of the website is to present works of art, the artistic journey and identity of the creator, and to provide a means of communication for inquiries regarding available artworks, custom creations, or general questions.

The content of the website is of an informational, presentational, and communicative nature. The presence of an artwork, description, image, or any other reference on the website does not automatically imply final availability, a binding offer, or the immediate conclusion of a sale without prior confirmation.

4. Access and Proper Use of the Website

The user must use the website in a lawful, fair, and proper manner in accordance with these Terms of Use, without violating the rights of third parties, principles of good faith, or the provisions of applicable law.

For this reason, any interest in purchasing an artwork must be confirmed through direct communication. Final confirmation as to whether an artwork is available is provided only after verification.

7. Images, Photographs, and Color Rendering

The photographs and visual representations of the artworks presented on the website aim to provide the most faithful possible visual representation of the works. Nevertheless, there may be minor or greater differences in the appearance of colors, shades, brightness, texture, or details, depending on the screen, device, browser, display settings, or other technical factors.

For this reason, the images displayed on the site are indicative and presentational in nature and cannot be considered absolutely identical to the physical visual experience of the artwork on every possible display medium.

8. Intellectual Property Rights and Rights in the Content

All content of the website, including indicatively the artworks, photographs, texts, descriptions, titles, visual presentation, structure, aesthetic identity, graphic elements, and any other creative or informational material, is protected by intellectual property rights and other applicable legal provisions. The purchase of a physical artwork does not by itself imply the transfer of the intellectual property rights or economic rights in relation to the image or reproduction of the artwork. These matters are also governed by the more specific terms described in the Terms of Sale & Orders.

9. Contact Forms and Submitted Information

Through the website, users may communicate for general inquiries, interest in purchasing an artwork, or requests for a custom creation. The user must submit truthful, accurate, and as complete as possible information so that their request can be processed properly.

It is not permitted to send misleading, false, abusive, offensive, or unlawful messages through the available contact forms.

The handling of personal data submitted through the website is carried out in accordance with the applicable Privacy Policy and, where relevant, the Cookies Policy.

In the event of inconsistency between a general provision of these terms and a more specific provision included in the Terms of Sale & Orders, the more specific provision shall prevail.

The website may be available in more than one language. In the event of any inconsistency, interpretative discrepancy, or variation between the Greek version and any translated version of the content or legal pages, the Greek version shall prevail.
